By requesting a quote, engaging our services, or using the website asbestosroofremoval.co.nz (the "Website"), you agree to be bound by these Terms and Conditions. If you do not accept these terms, do not use our services or website.

These terms constitute a legally binding agreement between you ("Client") and JP Asbestos ("Company," "we," "us," or "our"), a licensed asbestos removal contractor operating in New Zealand under the Health and Safety at Work (Asbestos) Regulations 2016.

JP Asbestos provides licensed asbestos removal (Class A and Class B), asbestos testing and inspection, asbestos management plan preparation, and re-roofing services (via preferred contractors) across Auckland and New Zealand.

All services are performed in accordance with the Health and Safety at Work Act 2015, the Health and Safety at Work (Asbestos) Regulations 2016, and all applicable WorkSafe NZ guidelines. Services are delivered by licensed, trained, and appropriately certified personnel.

Scope of services is defined in the written quote provided to the Client. Any variation to the agreed scope must be confirmed in writing before additional work commences. Additional work outside the agreed scope will be charged at rates specified in the variation agreement.

All quotes are provided in writing and are valid for 30 days from the date of issue. Quotes are based on the information and site conditions known at the time of assessment. JP Asbestos reserves the right to revise pricing if site conditions are found to differ materially from those described or observed at the time of quoting.

Unless otherwise stated, all prices are exclusive of GST. GST will be added to all invoices at the current applicable rate.

Free no-obligation quotes are offered for all jobs. Acceptance of a quote constitutes a binding contract for the services described. Verbal agreements are not binding all work is undertaken only on the basis of a written quote accepted by the Client.

Unless otherwise agreed in writing, payment terms are as follows:

  • Residential jobs: 50% deposit on acceptance of quote, balance on completion.
  • Commercial jobs: Payment terms as agreed in writing prior to commencement.
  • Invoices are due within 7 days of issue unless otherwise agreed.

Late payments attract interest at 2.5% per month on overdue amounts. JP Asbestos reserves the right to suspend work on any project where invoiced amounts are not paid within the agreed terms.

Payments are accepted by bank transfer, credit card, or as otherwise agreed. GST receipts are issued on payment of each invoice.

Cancellation of accepted quotes requires written notice. The following cancellation fees apply:

  • Cancellation with more than 5 working days' notice: Deposit refunded less any costs already incurred (e.g., WorkSafe notification fees, testing costs).
  • Cancellation with 2 5 working days' notice: 25% of total quoted price.
  • Cancellation with less than 2 working days' notice: 50% of total quoted price.

JP Asbestos reserves the right to reschedule work due to adverse weather conditions, WorkSafe NZ requirements, or other factors beyond our control. Rescheduling due to such circumstances does not constitute cancellation by either party.

The Client is responsible for ensuring that JP Asbestos personnel have safe and unobstructed access to the work area on the agreed work dates. Failure to provide access may result in additional mobilisation charges.

The Client must notify JP Asbestos of any known or suspected hazards on the property prior to commencement. This includes but is not limited to: underground services, structural instability, other hazardous materials, security systems, and specific access restrictions.

Occupants must not enter containment zones established during asbestos removal. JP Asbestos will provide clear notifications of exclusion zones. Failure to respect exclusion zones releases JP Asbestos from liability for any resulting exposure incidents.

To the maximum extent permitted by law, JP Asbestos's total liability to the Client for any claim arising from or related to our services is limited to the amount paid by the Client for the specific services giving rise to the claim.

JP Asbestos is not liable for indirect, consequential, or special damages, including but not limited to: loss of income, loss of use of property, or costs arising from delays beyond our reasonable control.

Nothing in these terms excludes liability that cannot be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where they apply.

JP Asbestos carries public liability insurance appropriate for the services we provide. Insurance details are available on request.

JP Asbestos operates in full compliance with New Zealand asbestos regulations, including the Health and Safety at Work (Asbestos) Regulations 2016. All Class A asbestos removal work is notified to WorkSafe NZ in accordance with the required 5 working days' notice period.

The Client is responsible for obtaining any resource consents, building consents, or neighbour notifications required for the work at their property. JP Asbestos is not responsible for obtaining such consents unless specifically agreed in writing.

All asbestos waste is disposed of at a consented landfill facility in accordance with NZ waste management regulations. Disposal receipts are provided to the Client as part of the compliance documentation pack.

JP Asbestos warrants that all asbestos removal work is performed by licensed, trained personnel using appropriate equipment and methods in accordance with NZ regulations.

Re-roofing work is warranted in accordance with the manufacturer's product warranty for the specified roofing materials. Workmanship warranties are provided as specified in the written quote for each project.

Warranty claims must be notified to JP Asbestos in writing within 12 months of project completion. Warranties do not cover damage caused by weather events, subsequent modifications by others, or conditions arising from the Client's failure to maintain the installed materials in accordance with manufacturer guidelines.

All content on this website, including text, images, logos, and design, is the property of JP Asbestos or is used with permission. You may not reproduce, distribute, or use any content from this website without prior written consent from JP Asbestos.

Quotes, reports, and documentation prepared by JP Asbestos for a specific project remain the property of JP Asbestos until full payment has been received, at which point they are provided to the Client for their own use in relation to the project.

By engaging our services, you consent to JP Asbestos collecting, holding, and using your personal information for the purposes of providing services, managing our relationship, and meeting regulatory requirements.

In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation in the first instance. If negotiation fails, disputes will be referred to mediation before any court proceedings are commenced.

For residential consumer disputes under the Consumer Guarantees Act 1993, you may also have recourse to the Disputes Tribunal or other relevant consumer dispute resolution bodies.

JP Asbestos reserves the right to amend these Terms and Conditions at any time. Amended terms will be published on this website and will apply to all new engagements from the date of publication. Continued use of our services following any amendment constitutes acceptance of the revised terms.

These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the New Zealand courts.
